No movement yet from the jury this morning. I just talked to a court insider who said there IS one scenario in which there would be a mistrial in the sentencing phase. If the jury comes back deadlocked with an even 6/6 split, the judge would have no authority to impose a sentence. If there are at least 7 votes for the death penalty, the judge can impose life without prison. If there are 5 or fewer votes for the death penalty, the judge can only impose life WITH the possibility of parole.

I look at it as either “Death” -or- “Life Without Parole”
He’s been convicted on 54-counts . . . .
Lets just say he was sentenced to one (1) year for each count; consectutively – That’s 54 years Nichols would have to serve putting him at 91-years-old before being released.
And – We all know Nichols is not going to be sentenced to just one (1) year on each of these counts.
He’s never getting released unless he escapes – Again !!

How I look to you for explanations…lol…I have no idea HOW the judge just ruled. As usual he was all over the place…..so if YOU understood, can you let us know are tape or tapes in or not….and if they are in….is it in entirety or just the snippets that are already in evidence. What would we do without you…lol

Escapes again – that is what is so scary to me. Do we know if the jury did or did not listen to the portion of the tape the judge allowed?

So far, the jury hasn’t listened to anything. That’s why the state started thinking, you know, they were probably confused by the judge’s instructions.
