The jury foreman just told the judge they are still deadlocked, and that they do not believe further deliberations will help.  So the judge just told them to go back and continue deliberating for two more hours.   If they still come back hung at 8pm, the judge will officially sentence Nichols to life in prison tomorrow morning.

    I’ll say it again…this is obviously a hung jury. You have here a judge who wants desperately to impose the death penalty in deference to his friend and colleague but he’s not getting it.

    Why subject the families to further distress. The prosecution has lost and righly so. Thank goodness for the 3 people who just understand the death penalty is barbaric and has no place in a modern society.

    God bless the victims but most unfortunately, as said before, executing this animal won’t bring them back. Let him spend the rest of his life in prison; I am sure the prison authorities are capable of seeing he never escapes.

    I’m not sure they are that capable and it worries me. The jury foreman was anti death penalty from the beginning – but he said he could impose it if there was a danger to others. I think this qualifies – and I’m concerned that Brian is smarter by far than prison guards. And he is certainly a very angry and a very determined person. It might take him 20 years, but I’m convinced he will find a way out. I’m not a pro DP person – but I’m for it in this case.
